Legal review required: These commercial terms should be approved by a South African attorney before becoming the final customer agreement.

1. The service

BEE Procured V5 provides procurement-data capture, supplier linking, B-BBEE evidence management, calculations, reporting and authorised administration tools. It supports professional work but does not replace independent verification, legal advice or a SANAS-accredited verification decision.

2. Accounts and access

Clients must provide accurate registration information, protect credentials, assign appropriate roles and notify MNA Investments of unauthorised access. Accounts and restricted functions may be used only by authorised people. The client is responsible for activity performed through its accounts unless caused by MNA Investments’ breach.

3. Fees and payment

Subscriptions are payable monthly in advance according to the selected written quotation. Published package prices exclude VAT. Setup, migration, training, customisation and integrations may be quoted separately. Overdue accounts may be suspended after reasonable notice.

4. Client data

The client retains ownership of its uploaded data and confirms that it has authority and a lawful basis to process it. MNA Investments may process client data only to provide, secure and support the service, comply with law and exercise its contractual rights. POPIA responsibilities are described in the Privacy Notice and any signed operator agreement.

5. Acceptable use

  • Do not upload unlawful, malicious or irrelevant content.
  • Do not attempt to bypass access controls, inspect other clients’ data or disrupt the service.
  • Do not share restricted Master Admin, certificate-review or demo credentials.
  • Do not represent system outputs as final verification without the required professional review.

6. Availability, support and changes

MNA Investments will use reasonable efforts to operate and support the service. Maintenance, security incidents, hosting failures and events outside reasonable control may affect availability. Features may evolve, provided that material changes are communicated and contracted obligations are respected.

7. Warranties and liability

Clients remain responsible for source-data accuracy, VAT treatment, certificate validity, sector selection and professional interpretation. To the extent permitted by law, neither party is liable for indirect or consequential loss. Any agreed liability cap and exclusions must be stated in the signed quotation or service agreement; rights that cannot legally be excluded remain unaffected.

8. Suspension, cancellation and termination

Cancellation notice, minimum term and data-export arrangements are confirmed in the quotation. MNA Investments may suspend access for material breach, security risk, unlawful use or non-payment. On termination, data is retained or deleted according to the agreement, POPIA and applicable legal obligations.

Governing law

These terms are governed by the laws of South Africa. Parties should first attempt good-faith resolution before using the agreed dispute process.
